A. General Terms and Conditions
§ 1 Scope of application, customers
These General Terms and Conditions apply to all business relationships between WTRMELON, Industriestraße 1–3, 63814 Mainaschaff, Germany (hereinafter referred to as the “Company”) and its customers, in the version valid at the time the contract is concluded.
Conflicting, deviating, or supplementary terms and conditions of the customer shall not become part of the contract, even if known, unless the Company has expressly agreed to them.
Customers within the meaning of these General Terms and Conditions are both consumers and entrepreneurs.

Consumers are natural persons who enter into a legal transaction for purposes that are not predominantly commercial or self-employed.

Entrepreneurs are natural or legal persons or partnerships with legal capacity who act in the exercise of their commercial or professional activities when concluding a legal transaction.
We supply customers in Germany, the European Union, the USA, Canada, and other international destinations.
We do not offer our goods for resale purposes. The Company may limit order quantities per person, household, or order and reserves the right to cancel orders suspected of being placed by dealers, resellers, or distributors.
§ 2 Offers and conclusion of contracts via the website
All offers are subject to change and non-binding. A contract is concluded only when the Company accepts the customer’s offer.
When a customer places an order via our website, we confirm receipt of the order. This confirmation does not constitute acceptance. A contract is concluded when we either explicitly accept the order by e-mail or dispatch the goods.
If the customer pays directly via online payment services such as PayPal, credit card, Google Pay, or Apple Pay, the contract is deemed concluded at the time the payment instruction is confirmed.
§ 3 Terms of payment and prices

All prices shown include the applicable German VAT (currently 19%), unless otherwise stated, but exclude shipping costs and possible customs duties (see § 4).
§ 4 Shipping costs and import duties
Shipping costs are charged in addition to the purchase price. The amount of shipping costs is displayed before order completion.
For deliveries outside the European Union (e.g., USA, Canada), additional import duties, customs fees, or taxes may apply. These charges are determined by local authorities and are the sole responsibility of the customer.
The Company is not responsible for any customs fees, taxes, or delays caused by border authorities.
§ 5 Default of payment
If the customer fails to pay after the due date and a reminder has been issued, the customer is in default. During the period of default, interest shall be charged at a rate of 5% above the base interest rate.
§ 6 Delivery, multiple shipments
Delivery is made to the shipping address provided by the customer. If the customer provides an alternative drop-off location to the carrier (e.g., DHL), risk passes to the customer once the parcel is delivered there.
If several items are ordered, the Company may ship in multiple parcels at no extra cost to the customer.
§ 7 Delivery times
Orders are usually dispatched within 2–7 working days after receipt of payment.
§ 8 Transfer of risk

For entrepreneurs, the risk of accidental loss passes to the buyer once the goods are handed over to the carrier.

For consumers, the risk passes only upon actual delivery.
§ 9 Retention of title
The goods remain the property of the Company until full payment has been received.
§ 10 Right of withdrawal & return costs
Consumers are entitled to the statutory right of withdrawal. The withdrawal period is 14 days from receipt of goods.
All returns (Germany, EU, USA, Canada, International) must be sent at the customer’s expense to:

Customers must ensure goods are unused, unworn, and in original packaging with tags.
Refunds will be processed within 1–7 business days after inspection.
We kindly ask customers to contact us regarding size questions before ordering, as unnecessary returns affect our logistics and charity donation calculations.
§ 11 Warranty and liability
The customer’s warranty rights and the Company’s liability are governed by statutory provisions.
§ 12 Data protection
We handle customer data confidentially in accordance with GDPR and other applicable laws. Data is only shared with third parties for contract fulfillment (e.g., payment service providers, shipping carriers).

§ 13 Final provisions, place of jurisdiction, severability clause

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

If mandatory consumer protection laws of the customer’s country of residence (e.g., USA or Canada) apply, these remain unaffected.

For merchants, the exclusive place of jurisdiction is Aschaffenburg, Germany.

Should any provision be invalid, the remaining provisions shall remain unaffected.
Contracts may be concluded in German or English.
